1. Acceptance of Terms

By accessing or using OutlierOS (" the Platform") operated by Foxxception LLC, you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Platform Description

OutlierOS is a cognitive assessment and talent discovery platform. It provides AI-generated thought experiments to map cognitive architecture across 8 dimensions. The Platform connects assessed individuals ("Builders") with subscribing organizations ("Companies").

OutlierOS is not a recruitment agency, staffing firm, employment agency, or headhunting service. We do not source candidates, negotiate offers, place individuals into roles, or take placement fees. The Platform is a self-service information and assessment tool designed to complement — not replace — existing HR teams, recruiters, and hiring processes. OutlierOS provides an additional data point for talent evaluation. Companies use cognitive profiles alongside their own hiring workflows to inform their own independent hiring decisions. Any introduction facilitated through the Platform is between the Company and the Builder directly — Foxxception LLC is not a party to any employment relationship.

No guarantees on performance, placement, or hiring outcomes. Foxxception LLC makes no representations or warranties regarding the performance, qualifications, reliability, or suitability of any Builder for any role. Cognitive profiles are informational tools — not endorsements, certifications, or guarantees of job performance. Companies are solely responsible for their own hiring decisions, due diligence, and compliance with applicable employment laws. Foxxception LLC is not liable for any hiring decision, employment outcome, or candidate performance resulting from the use of the Platform.

3. Assessment & Scoring

OutlierOS is an assessment and design tool. Scores represent cognitive processing patterns, not intelligence, competence, or employability. All scoring is generated by AI and should be interpreted as one signal among many. Scores are not "good" or "bad" — they map how you think.

Assessment prompts are generated uniquely for each session. Attempting to manipulate, reverse-engineer, or share assessment prompts or scoring methodology with the intent to undermine the Platform's integrity may result in account termination.

4. Builder Accounts

Builder accounts are free. By taking the assessment, you consent to your cognitive profile being visible in the OutlierOS directory. You control what contact information, if any, is shared with Companies. You may request deletion of your profile and data at any time by contacting us.

5. Company Subscriptions

Company access is available via monthly ($999/mo), annual ($9,990/yr), or lifetime ($10,000 one-time) subscriptions processed through Stripe. All subscriptions are non-refundable. Monthly and annual plans may be cancelled at any time and will remain active through the end of the paid period.

6. Affiliate Program

Builders may participate in the OutlierOS affiliate program. Commission rates range from 30% to 80% and are earned on company subscriptions referred through unique affiliate links. Payouts are processed monthly via Stripe. Affiliates must be US-based individuals or entities. Tax forms (W-9/W-8BEN) are collected through the affiliate dashboard. Earnings over $600/year are reported via 1099-NEC.

7. Acceptable Use

You agree not to: (a) use the Platform for any unlawful purpose; (b) attempt to gain unauthorized access to Platform systems; (c) scrape, harvest, or collect data from the Platform without authorization; (d) misrepresent your identity or the identity of another person during assessments; (e) share, resell, or redistribute assessment content or scoring methodology.

8. Intellectual Property

All assessment prompts, scoring algorithms, cognitive dimension frameworks, and Platform design are the intellectual property of Foxxception LLC. Your cognitive profile data belongs to you. We claim no ownership over your assessment responses or personal information.

9. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that assessment scores will be accurate, complete, or suitable for any particular purpose including hiring decisions.

11. Limitation of Liability

To the maximum extent permitted by law, Foxxception LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Platform, including but not limited to hiring decisions made based on cognitive profiles.

12. Indemnification

You agree to indemnify, defend, and hold harmless Foxxception LLC, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) any hiring decision you make based on cognitive profile data; (d) any content or information you submit to the Platform; or (e) your violation of any applicable law or regulation.

13. Dispute Resolution & Arbitration

Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules. Arbitration shall take place in Maricopa County, Arizona. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver. You agree that any arbitration or legal proceeding shall be conducted on an individual basis only, and not as a class action, collective action, or representative proceeding. You waive any right to participate in a class action lawsuit or class-wide arbitration against Foxxception LLC.

Exception. Either party may seek injunctive or equitable relief in a court of competent jurisdiction for claims related to intellectual property infringement or unauthorized access to the Platform.

14. Account Termination

We reserve the right to suspend or terminate your account at any time, for any reason, with or without notice, including but not limited to: violation of these Terms, suspected fraud, conduct harmful to other users, or conduct harmful to the business interests of Foxxception LLC. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including indemnification, limitation of liability, dispute resolution, and intellectual property) shall survive.

You may delete your account at any time by contacting support@foxxception.com. Company subscriptions remain non-refundable upon account deletion.

15. Eligibility

You must be at least 18 years of age to use the Platform. By using OutlierOS, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

16. Modifications

We reserve the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms. Material changes will be communicated via the Platform or email.

17. Governing Law

These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict of law principles.
